NO HARASSMENT POLICY
All of our employees have the right to work in an environment free from all forms of discrimination and conduct which can be considered harassing, coercive or unduly disruptive. We will not tolerate harassment of any of our employees that is inconsistent with the Company’s EEO Policy or any other policy maintained by the Company. Any form of harassment related to an individual’s race, color, religion, sex, national origin, age, genetic information, veteran status, disability, sexual orientation, gender identity, or any other characteristic protected by law is a violation of our policy and will subject you to discipline up to and including discharge.
For these purposes, the term harassment refers to unwelcome behavior, which may be personally offensive and may include slurs and other offensive remarks, jokes, and other verbal, graphic, or physical conduct that is in any way inconsistent with the Company’s EEO policy. Harassment also includes sexual advances, requests for sexual favors, unwelcome or offensive touching and other physical contact of a sexual nature.
Complaint Procedure: Any violation of the Company’s EEO or Non-Harassment policies should be reported immediately. Anyone who feels that he or she is the victim of a violation of these policies should contact his or her supervisor or manager. If the complaint involves the Employee’s supervisor or someone in the direct line of supervision, or the employee for any reason is uncomfortable in dealing with his or her immediate supervisor, the employee may go to another supervisor or directly to the President or Personnel Office. The Company prohibits any form of retaliation against an employee for reporting an alleged violation of the non-discrimination policy or anti-harassment policy, and an employee, who reports, in an appropriate manner, an alleged violation of this policy, will not be subjected to adverse employment action because of the complaint.
Investigation of Complaints: The Company will promptly and thoroughly investigate all complaints of harassment or other violations of our EEO policy to determine whether improper conduct has occurred. All employees are expected to cooperate fully in any investigation. We will endeavor to maintain, but cannot guarantee, the confidentiality of all complaints to the fullest extent possible while allowing our Company to conduct a full and fair investigation.
Disciplinary Action: It is the responsibility of everyone to ensure adherence to our Company’s policy of equal employment opportunity and non-discrimination for all individuals. Anyone found to have violated our Company’s equal employment opportunity or no-harassment policies will be subject to appropriate disciplinary action, up to and including termination of employment.
WORKPLACE VIOLENCE AND SECURITY POLICY
The Company is committed to maintaining a safe, healthful and productive working environment where employees, customers and company assets are free from the threat of violence. Consistent with this commitment the Company has adopted a “Zero Tolerance” policy for any words or actions that threaten employees, customers or other visitors to our business. This policy applies to all employees, their relatives or acquaintances, and visitors to any Company location.
• The Company will not tolerate violence or threats of violence in the workplace or in the course of conducting its business. If any employee is subject to threats of violence or is a witness to a threat or an act of violence from an employee, customer or any other person while at work (or at any time during the course of their employment), he or she must immediately contact their supervisor or the Personnel Office.
• The Company will not tolerate threatening, abusive, intimidating or harassing behavior of any kind; possession or use of firearms or any other weapons; use of drugs or other controlled substances; obscene or threatening language; physical attacks on any person; or the intentional destruction of another’s personal property, whether during the course of employment or in any area around the workplace.
• Any employee who threatens or commits an act of violence, threatens use of a weapon, engages in intimidating behavior of any kind or manner while on the job or in an area around the workplace will be subject to disciplinary action, up to and including discharge.
For purposes of this policy, the workplace is any location, either permanent or temporary, where an employee performs any work-related duty for the Company. This includes, but is not limited to, the building and the surrounding perimeters including the parking lot and alternate work locations. Also included is travel to and from work assignments during an employees regularly scheduled hours of work.
All employees of the Company are required to adhere to the procedures outlined in this policy. More specifically, all employees are responsible for:
• Complying with all Workplace Violence and Security Plan policies and procedures.
• Immediately notifying their supervisor or the Personnel Office of any incidents of workplace violence, threats and security-related problems.
• Prohibiting non-employees access to any building or parking area unless they have signed-in at the reception desk and received a visitor’s pass or are escorted by an authorized Company representative.
• Cooperating in any investigation of a violation of this policy.
• Notifying authorities (911) in the case of an actual or imminent threat of violent activity or behavior. All employees are expected to cooperate with security and law enforcement personnel.
The Company prohibits any form of retaliation against an employee for filing a complaint under this policy or for assisting in a complaint investigation.
Prohibited Behavior
Consistent with this “Zero Tolerance” policy, The Company prohibits any employee from engaging in any act either on Company premises or during the performance of work-related duties that:
• Threatens the safety of an employee and/or customer.
• Affects the health, life or well-being of an employee and/or customer.
• Results in damage to Company, employee or customer property.
Included in the above prohibitions are the following:
• Threatening, intimidating, coercing, and/or harassing (including sexual harassment) actions by an employee, visitor or customer.
• Carrying or possessing weapons while on Company property or concealing a weapon while on Company property.*
• Allowing unauthorized persons access to a Company building or confidential information without management approval.
• Using, duplicating or possessing keys to any Company building or offices within a building without authorization from management.
• Stealing or attempting to steal property of the Company, an employee or customer.
• Damaging or attempting to damage property of the Company, an employee or customer.
• Computer misuse as described in the Electronic Communication Policy.
* In accordance with Indiana law, this policy does not and shall not be construed to prohibit an employee from keeping a legally possessed firearm locked in the trunk of the employee's vehicle, kept in the glove compartment of the employee's locked vehicle, or stored out of plain sight in the employee's locked vehicle that is parked in the company parking lot.
Reporting & Investigation
Consistent with the Company’s obligation to provide a safe, healthful and productive workplace, any employee who engages in conduct prohibited by this policy will be subject to appropriate disciplinary action, as determined by the findings of a prompt, objective and impartial investigation. Such discipline may include a warning, suspension or immediate termination. Determination of the appropriate form of disciplinary action is the sole discretion of the Company. In addition, certain actions may create employee liability under state and/or federal law.
